End User License Agreement
This End User License Agreement ("EULA") is a legal agreement between you ("User," "you," or "your") and Intellorix LLC, a Delaware limited liability company ("Intellorix," "Company," "we," "our," or "us"), governing your use of the Word Blazer mobile application and related services (the "Application").
By downloading, installing, or using the Application, you agree to be bound by this EULA. If you do not agree to this EULA, do not download or use the Application.
1. Acknowledgement
This EULA is concluded between you and Intellorix LLC, and not with Apple Inc. Intellorix LLC is solely responsible for the Application and its content.
To the extent this EULA provides for usage rules for the Application that are less restrictive than the Apple Media Services Terms and Conditions, the Apple Media Services Terms and Conditions will apply.
2. Scope of License
Intellorix LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application on any Apple-branded device that you own or control and as permitted by the Apple Media Services Terms and Conditions.
This license is solely for personal, non-commercial use.
You may not:
- distribute or make the Application available over a network where it could be used by multiple devices at the same time
- rent, lease, lend, sell, redistribute, or sublicense the Application
- copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Application
Any attempt to do so is a violation of the rights of Intellorix LLC and its licensors.
3. Ownership
The Application is licensed, not sold, to you.
Intellorix LLC and its licensors retain all rights, title, and interest in and to the Application, including all intellectual property rights.
All trademarks, service marks, logos, and branding associated with the Application are the property of Intellorix LLC.
4. Maintenance and Support
Intellorix LLC is solely responsible for providing any maintenance or support services for the Application.
Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Application.
5. Warranty
To the extent not effectively disclaimed under applicable law, Intellorix LLC is responsible for addressing any claims by you relating to the Application, including but not limited to:
- product liability claims
- claims that the Application fails to conform to any applicable legal or regulatory requirement
- claims arising under consumer protection, privacy, or similar legislation
The Application is provided "as is" and "as available."
To the maximum extent permitted by law, Intellorix LLC disclaims all warranties, whether express, implied, statutory, or otherwise.
6. Product Claims
You acknowledge that Intellorix LLC, and not Apple, is responsible for addressing any claims relating to the Application or your possession and use of the Application.
7. Intellectual Property Claims
In the event of any third-party claim that the Application infringes another party's intellectual property rights, Intellorix LLC, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
8. Legal Compliance
You represent and warrant that:
- you are not located in a country subject to a U.S. Government embargo
- you are not listed on any U.S. Government list of prohibited or restricted parties
You agree to comply with all applicable laws regarding the use of the Application.
9. Third-Party Terms of Agreement
You must comply with applicable third-party terms when using the Application.
For example, if the Application uses third-party services or advertising networks, you must comply with their applicable terms of service.
10. Third-Party Beneficiary
You acknowledge and agree that Apple Inc. and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of the terms and conditions of this EULA, Apple will have the right to enforce this EULA against you as a third-party beneficiary.
11. Limitation of Liability
To the fullest extent permitted by law, Intellorix LLC shall not be liable for:
- indirect or consequential damages
- loss of profits
- loss of data
- service interruptions
- gameplay losses or leaderboard inaccuracies
In no event shall Intellorix LLC's total liability exceed the amount you paid for the Application within the previous twelve months.
12. Termination
This license is effective until terminated.
Your rights under this license will terminate automatically if you fail to comply with any term of this EULA.
Upon termination, you must stop using the Application and delete all copies of it from your devices.
13. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
14. Changes to This Agreement
Intellorix LLC reserves the right to modify this EULA at any time.
Updated versions may be posted on wb.intellorix.com.
Continued use of the Application after changes are published constitutes acceptance of the revised EULA.
